Marketing and Communications Policy

This policy explains how SOLUTECH WEST LLC communicates with prospects and clients, what consent we obtain before doing so, and how you can stop our communications at any time. It is designed to comply with the CAN-SPAM Act (15 U.S.C. §§ 7701–7713 and 16 C.F.R. Part 316), the Telephone Consumer Protection Act (47 U.S.C. § 227 and 47 C.F.R. § 64.1200), the Florida Telephone Solicitation Act (Fla. Stat. §§ 501.059 and 501.616), and FTC rules on advertising, endorsements and reviews.

1. General principle

We only write or call you if you gave us your information with a reasonable expectation of hearing from us, or if you expressly authorized us to do so. We never buy, rent or scrape contact lists, and we do not send commercial communications to addresses harvested from the web.

We distinguish two kinds of message:

  • Commercial messages, whose primary purpose is to promote our services (newsletters, offers, event invitations, nurturing content). These require your consent and always include an opt-out mechanism.
  • Transactional or relationship messages: confirmations of your requests, proposals you asked for, invoices, security notices, service updates and communications about an active agreement. These are not advertising and do not stop with a marketing opt-out, because they are necessary to the relationship. You can end them by cancelling the relevant service.

2. How we obtain your consent

  1. Site forms. An unchecked checkbox next to the submit button, separate from acceptance of the Terms. Leaving it unchecked does not prevent you from submitting the form or receiving our reply.
  2. Newsletter subscription or resource download, with email confirmation (double opt-in).
  3. Business relationship — communications about the contracted service and, unless you object, related services.
  4. Your express request by email, chat, business WhatsApp or in a meeting, with a written record.

Marketing consent is never a condition of purchase. What we record as proof: date/time with time zone, IP address, exact page URL, the literal consent text displayed, the checkbox state, and the browser identifier — retained for 5 years.

3. Email — CAN-SPAM Act compliance

  • Truthful headers. The "From," "To," "Reply-To" and routing information accurately identify SOLUTECH WEST LLC. We never falsify or obscure the origin.
  • Honest subject lines. The subject line accurately reflects the content of the message. We do not use deceptive subject lines, false urgency, or fake reply threads.
  • Identification as advertising. Messages whose primary purpose is commercial are clearly and conspicuously identified as such.
  • Valid physical postal address. Every commercial email includes our registered postal address: 2 S Biscayne Boulevard, Suite 3200 – 6949, Miami, FL 33131, United States.
  • Clear and functional opt-out. Every email includes a conspicuous unsubscribe link that works with a single click, requires no login, costs nothing, and asks for no information other than your email address. The link stays operational for at least 30 days after the message is sent.
  • Prompt processing. We process opt-outs immediately and in any case within 10 business days at most. In practice we do it in under 72 hours.
  • Responsibility for third parties. When we hire a platform or agency to send our emails, we remain responsible for compliance. We audit our providers and require these same standards contractually.

After opting out. We add your address to a permanent suppression list that is checked before every send, including sends performed by external providers. We never sell, rent, transfer or share the address of a person who has opted out, except with the provider that helps us enforce the opt-out.

How to opt out: click "Unsubscribe" at the bottom of any of our emails, or write to legal@solutechwest.com with the subject "UNSUBSCRIBE."

4. Telephone calls

  • Manual dialing. Our commercial calls are placed manually, by a person. We do not use automatic telephone dialing systems or artificial or prerecorded voice messages for cold commercial outreach.
  • Calling hours. We do not call before 8:00 a.m. or after 8:00 p.m., local time of the person called. We adopt the 8:00 p.m. limit required by Florida law, which is stricter than the federal standard.
  • Frequency. We do not place more than three commercial calls to a prospect within any 24-hour period on the same subject.
  • Identification. At the start of the call we identify the caller, state that the call is on behalf of SOLUTECH WEST LLC, and offer a contact phone number or address. We always transmit our real number; we never spoof caller ID.
  • National Do Not Call Registry. We scrub our lists against the National Do Not Call Registry using a version of the registry obtained no more than 31 days before each campaign. We call registered numbers only where express consent or an established business relationship exists (18 months from a transaction, 3 months from your inquiry).
  • Internal do-not-call list. If you ask us not to call again, we record the request at the time it is made, give it effect within 10 business days at most, and retain it for at least 5 years. Our written do-not-call policy is available on request, and all sales personnel are trained on its use.

To ask us not to call: say so during the call, or write to legal@solutechwest.com identifying the number to be excluded.

5. Text messages, SMS and WhatsApp

Current status: SOLUTECH WEST LLC does not send commercial text messages or WhatsApp messages. We may use messaging to respond to a conversation you started, or to coordinate an already-scheduled meeting.

If we activate commercial SMS or WhatsApp communications in the future, we will apply the following rules and update this policy before sending the first message:

  • Prior express written consent. We will request a specific, separate authorization via an unchecked checkbox that identifies SOLUTECH WEST LLC by its legal name, the number authorized to receive messages, the type and estimated frequency of messages, and an express statement that consent is not a condition of purchase of any service. Electronic signature is valid under the E-SIGN Act.
  • Double opt-in. We will send an initial confirmation message that you must reply to in order to activate delivery.
  • Required disclosures at the point of capture: "Message and data rates may apply. Reply STOP to opt out and HELP for help." With links to this policy and the Privacy Policy.
  • Keywords. We will honor STOP, QUIT, END, REVOKE, OPT OUT, CANCEL and UNSUBSCRIBE, as well as any other reasonable expression of your wish to stop receiving messages, including those sent by email or voice. We will not designate an exclusive opt-out channel.
  • Timing. We will give effect to the opt-out immediately and in any case within 10 business days at most. We may send a single opt-out confirmation message, containing no promotional content.
  • Global revocation. An opt-out on any channel will apply to all our commercial calls and messages, regardless of subject. We adopt this standard voluntarily now, ahead of its January 31, 2027 compliance date.
  • Hours. Between 8:00 a.m. and 8:00 p.m., local time of the recipient.
  • WhatsApp. We will apply the same prior express written consent standard, in addition to the WhatsApp Business Commercial and Messaging Policies.

6. Advertising, case studies and testimonials

Governed by FTC Act Section 5, the Endorsement Guides (16 C.F.R. Part 255) and the Consumer Review Fairness rule (16 C.F.R. Part 465):

  • Substantiation before publication. Any figure, percentage or results claim we publish is supported by documented evidence before it is disseminated, and we retain that support for as long as the claim is published.
  • No ranking promises. We do not guarantee positions on Google or any other search engine, nor specific volumes of traffic, leads or revenue. Third-party algorithms are outside our control. Any projection we present is a substantiated estimate, identified as such.
  • Typical results. When we publish a case study with standout results, we also state the result a client can generally expect. We do not rely on a "results may vary" disclaimer to present an exceptional outcome as ordinary.
  • Authorization and truthfulness. We publish client names, logos, testimonials and data only with written authorization. Every testimonial reflects the real experience of a real person. We do not create, buy, sell or disseminate fake reviews or testimonials, nor AI-generated content posing as clients.
  • Disclosure of material connections. If a person giving a testimonial received a discount, free service, referral commission or any other incentive, we disclose it alongside the testimonial. The same applies if they are an employee, partner, family member or investor of SOLUTECH WEST LLC.
  • No sentiment-conditioned incentives. We never offer compensation in exchange for a review being positive, nor ask for a negative one to be removed.
  • No review suppression. We do not use unfounded legal threats, intimidation or abusive reporting to remove negative reviews, and we do not selectively display only favorable reviews as if they were all of them.
  • No fake metrics. We do not buy followers, likes, views or any other indicator of social influence.
  • Clear and conspicuous disclosures. Necessary qualifications appear next to the claim they qualify, in legible size and contrast, on desktop and mobile, and in the same medium as the message (in video, both visually and audibly).

Note on our marketing services. When we run campaigns for clients through MOBIK STUDIO, we apply these same standards and contractually require the client to substantiate any claim provided to us for publication. We may decline to publish a claim we cannot support.

7. Targeted advertising and audience data

We use Meta, Google and LinkedIn advertising platforms to reach professional audiences, including remarketing audiences built from visits to our site. Activation of those tools depends on your cookie consent. You can opt out through Your Privacy Choices or the "Cookie preferences" button. Details in the Cookie Policy.

We do not target campaigns to the European Economic Area or the United Kingdom.

8. How to stop all our communications

Write to legal@solutechwest.com with the subject "FULL OPT-OUT," stating the email address and phone number to be excluded. We will remove you from all our commercial lists, across all channels, and confirm in writing. We will retain only the minimum data needed on our suppression list to guarantee we do not contact you again.

9. Contact and updates

We update this policy when our communication channels or the applicable rules change. If we activate commercial SMS or WhatsApp, we will publish the update before the first send.
